Yogi govt sets standards for inspecting technical fitness of vehicles under new policy

Lucknow: The Yogi Cabinet has recently approved a new policy for Automated Testing Stations (ATS) for the technical inspection of vehicles. The state government has also issued guidelines regarding identification of eligible applicants for establishing private Automated Testing Stations under this policy.

According to these guidelines, only a maximum of three stations will be allotted to an applicant in the state including the ATS currently operated by him. Each applicant will be allowed to establish only one station in a district, and a maximum of 3 stations in the state. The allocation of ATS will be made based on the ‘first come, first serve’ policy.

Applications can be made after 21 days of notification

As per the issued rules and regulations, all eligible applicants interested in this policy will be eligible to apply on the National Single Window System portal (https://www.nsws.gov.in), 21 days after the date of notification of this policy.

Once applicants meets the eligibility criteria, a maximum of 3 applicants in the respective district will be issued Preliminary Registration Certificates and will have to appear for the examination. However, if any of the three candidates fails in the examination, the next applicant in line will be considered for the allocation as per the ‘first come, first serve’ policy.
The Transport Commissioner will issue the Preliminary Registration Certificate and the Registration Certificate under the Central Motor Vehicle Rules for initial registration and renewal for ATS.

ATS will have a minimum of 2 lanes

Each Automated Testing Station will have a minimum of 2 lanes. One lane will be designated for light vehicles and the other lane for medium/heavy vehicles. For the establishment of such an ATS, a minimum of 2 acres of land will be mandatory.

However, if any applicant is interested in establishing an ATS with more than 2 lanes, they will need an additional 0.5 (half) acre of extra land per lane, in addition to the minimum 2 acres. Applicants have the option to establish a two-wheel lane as per their preference.

The land for the newly established ATS will be located within the respective district on a national highway, state highway, or major district road. There should be no high-tension power lines above the land.

Land details will have to be submitted along with the application

At the time of application, the applicant must provide proof of ownership of the designated land. If the applicant does not own the designated land and is interested in taking it on lease or rent, they must present a notarized consent letter from the landowner on a stamp paper of Rs 100, along with certified documents of land ownership for a minimum of 10 years.

The ATS premises will have separate entry and exit gates for vehicles to ensure smooth flow of traffic. The approach road to the premises should have a minimum width of 7 meters. During entry and exit from the ATS, the vehicle’s entry will be recorded, enabling the authorities to track the duration of their stay at the center.

Net worth of the applicant should be minimum Rs 3 crores

As per the issued rules, the applicant’s net worth should be a minimum of Rs 3 crore for establishing an ATS, and for more than one ATS, the applicant’s net worth should be a minimum of Rs 7 crore.

Furthermore, the applying individual, or the MD/CEO/all partners of the firm/institution applying, will provide an affidavit stating that they have not been declared ineligible/banned/blacklisted by any state government in the past three financial years.

In case the selected applicant does not commence construction work within 2 months from the date of issuance of the Preliminary Registration Certificate, a penalty of Rs 5,000 per month will be imposed. If the construction work is not initiated within 4 months, the Preliminary Registration Certificate will be automatically cancelled.
