Bhagalpur: Escaping clutches of law is difficult is something rightly said. At least case of Niraj Modi a school of teacher of Madhura Simanpur village under Ishipur Barahat police station of Pirpainty block in this district has proved it true. Found guilty of raping a girl, all attempt of Modi to mislead court failed to save him from punishment of crime he had committed.
The seventh additional district and sessions judge Lavkush Kumar yesterday awarded him imprisonment of 14 years and fine of Rs 1 lakh besides payment of Rs 3 lakh to victim as compensation. In October 2018 a case had been registered against Modi in Ishipur Barahat PS in connection with rape of the victim.
He was in news in recent past after it came to light that Modi along with his father had executed a foolproof plan to establish himself dead in bid to evade punishment. However he landed himself in jail after facts came to light. Rajaram Modi alias Rajo Modi partner in drama enacted by his son for establishing himself dead was also arrested.
Modi who had been facing trail in special POCSO court in connection with charges against him, managed to procure his death certificate on basis of fake documents and photographs. In order to procure false death certificate he got himself photographed lying on funeral pyre and his father lighting his pyre.
Modi had also submitted fake receipt related to purchase of wood at burning ghat for procuring false death certificate. Rajaram Modi father of Modi later submitted his death certificate along with affidavit in court stating his son was no more alive.
On basis of death certificate and affidavit submitted by his father, file of Modi was subsequently closed. For Modi everything remained normal till the time mother of victim came to know that he was alive and his father had misled court.
She subsequently intimated BDO, Pirpainty that Modi is alive and he has wrongly managed to procure false death certificate. Following enquiry death certificate of Modi was cancelled in May, 2022. A case of forgery was registered against Rajaram Modi after death certificate of his son was cancelled by order of BDO. The special POSCO court was also subsequently intimated about cancellation of death certificate of Modi which led to reopening of his case. In trial completed after reopening of the case Modi was found guilty under provisions of POCSO Act.
