Accused attempts to skip law by establishing himself dead

Bhagalpur: Attempt of an accused here to escape clutches of law could fascinate many Bollywood scriptwriters. Effort of Niraj Modi, a school teacher of Madhura Simanpur village under Ishipur Barahat police station of Pirpainty, to mislead court by establishing himself dead has all ingredients of providing food for thought to script writer of thrillers.

Modi a rape accused, in order to skip law executed a foolproof plan to establish himself dead. However he landed himself in jail yesterday after truth came to light. His father Rajram Modi alias Rajo Modi was partner in drama enacted by his son for establishing himself dead.

Father of the accused was arrested earlier after facts about fake death came to light. Nairaj Modi, who is a school teacher, was charged of raping a student on October 14, 2018. A case was registered against him at Ishipur Barahat PS in connection with the charges.

Modi facing trial in special POCSO court here subsequently procured his death certificate by producing fake documents and photographs. As per information in order to procure death certificate he got himself photographed lying on funeral pyre and his father lighting his pyre besides he also managed to procure fake receipt related to purchase of wood at burning ghat.

On basis of fake photographs and receipt father of Modi managed to procure his death certificate. Rajaram Modi later misled court by submitting false death certificate of his son with affidavit. On basis of death certificate and affidavit submitted by father of Niraj Modi his file was closed by court subsequently.

For the Modi everything remained normal till the time mother of victim came to know that he has misled court by submitting false death certificate. She subsequently wrote a petition intimating BDO Pirpainty that Niraj Modi is alive and his father Rajaram Modi has been issued his false death certificate.

The BDO who found the allegation true, on May 21, 2022 ordered for cancelling death certificate and registering case against Rajaram Modi. A case of forgery was registered against Rajaram Modi at Ishipur Barahat PS in light of the directive.

The special POCSO court was also subsequently intimated about cancellation of death certificate of Niraj Modi. Seventh ADJ cum special judge Lavkush Mishra in turn sought report from SHO Ishipur Barhat on July 23, 2022, whether Niraj Modi was alive or dead.

For deposition the SHO was subsequently directed by court to appear r physically in court on September 7, 2022 for deposition. Jai Karan Gupta, special public prosecutor, POCSO court told View19.in that Niraj who was found alive surrendered in court yesterday. He was sent to jail for 14 days on judicial remand following his surrender, special public prosecutor added.
